SGWatchHub.sg does not pre-screen users or the content or information provided by users and cannot ensure that a buyer or seller will complete a transaction.

Consequently, SGWatchHub.sg does not transfer legal ownership of items from the seller to the buyer and cannot guarantee the true identity, age, nationality, or sense of humor of a user.

You agree that SGWatchHub.sg is not responsible or liable for any content, such as data, text, information, usernames, graphics, images, photographs, profiles, audio, video, items, and links posted by you, other users, or outside parties on SGWatchHub.sg. You use the SGWatchHub.sg platform at your own risk.

2. Use of the Services

SGWatchHub.sg reserves the right to revoke benefits, terminate or suspend accounts, and recover rewards or payments in cases of fraudulent activities or violations of these terms.

3. Account

In order to access certain parts of the Services, you must have an account with SGWatchHub.sg (“Account”). Upon creating an Account, you affirm and warrant that:

• If you are an individual, you are at least 18 years old.
• If you are representing a company, organization, or any other legal entity (“Entity”), you possess the authority to bind the Entity to these Terms.
• You have the legal capacity to enter into and fulfill binding contracts under applicable law.
• All information provided by you is accurate, current, truthful, and complete.

If you are under 18 years old, you may only utilize the Services with the consent and supervision of your parent or legal guardian, who will assume responsibility for all your activities.

You may not lend, transfer, or sell your Account or user ID to another party, nor may you utilize another user’s Account without their consent. Accordingly, SGWatchHub.sg retains the right to suspend or terminate your Accounts and/or access to the Services at any time, without prior notice.

SGWatchHub.sg reserves the right to consider multiple Accounts established by or on behalf of the same user, whether authorized by SGWatchHub.sg or not, as a unified entity. This includes combining funds held in multiple Accounts, including debiting any such Account to settle debts, payments, and refunds associated with any other Account held by you or on your behalf. For example, if you engage in a Prohibited Transaction using one of your multiple accounts, SGWatchHub.sg may utilize the funds in that account and/or any other accounts to reimburse a buyer for up to the amount equivalent to the monies paid by the buyer in connection with that Prohibited Transaction.

4. Fees and Payments

Depending on the type and/or number of listings you choose to post and any additional services you may request in relation to your Account or listing, you may be charged subscription fees, listing fees, quota fees, user fees, etc. You may pay the fees using a credit card, debit card, cheque, or by way of telegraphic or other electronic means of transfer. You may also pay your fees through any of the methods as may be made available on the Platforms or as may be notified to you from time to time.

You acknowledge and agree that:

• In the event of a subscription or recurring payment, you shall ensure that all payments are made and cleared by your bank before each monthly and/or annual recurring payment is due. For payments by credit card, your credit card account must be in good standing and remain valid for the monthly/annual charge(s) to be debited successfully. In the event of an unsuccessful payment, your account may automatically be suspended and/or terminated if payments are not received within ten (10) days from the due date.
• If your credit card has expired, or if you wish to use a different credit card, please notify us promptly.
• Save as set out in this Clause, all subscription fees, listing fees, and/or other fees and charges paid by you to us with respect to your Account or otherwise for your access to and use of the Services are non-refundable. For the avoidance of doubt, there will be no refunds of any Fees in the event that: (i) your Account is suspended or terminated due to a breach of these Terms; and/or (ii) any Content has been removed in accordance with these Terms.
• You shall make prompt payment of all Fees, in full before the due date stipulated by SGWatchHub.sg for such payment (where applicable) and in accordance with our payment instructions. In the event of late payment or non-payment of amounts due to SGWatchHub.sg, without prejudice to any other rights or remedies available to us, SGWatchHub.sg shall be entitled to: (i) terminate and/or suspend your Account and/or your access to the Services; and/or (ii) charge you a late payment fee on the overdue amount at the rate of 1.5% per month, or, if lower, the maximum rate allowed by applicable law. You shall pay such fees together with the overdue SGWatchHub.sg Fees and any legal fees and collection costs incurred by SGWatchHub.sg in collecting any past due amounts. This fee will be applied on the day after the payment due date and will be applied each month until the overdue amount is paid.
• In the event your Account is suspended or terminated for any reason, any amounts due on your Account will immediately become due and payable. SGWatchHub.sg reserves the right to immediately charge any amounts you have not previously disputed to the billing method that you are using and shall be entitled to terminate your Account, without prejudice to any other rights or remedies available to us.
• You are responsible for collecting and paying any taxes associated with using and making sales through the Services. Depending on the tax legislation of your country of residence, goods and services tax or similar consumption tax might apply in addition to your fees.

4.1 Listing Fees & Quota

• You may be limited to a maximum number of active listings you may publish on your profile at a time (“Listing Quota”) or on the number of buyers you can reply to in a specific category at a time (“Reply Quota”). Any additional listing insertion may be subjected to a fee depending on SGWatchHub.sg’s prevailing fees’ rules and charges.
• You acknowledge and agree that SGWatchHub.sg does not represent or warrant that any Fees paid or payable will lead to a like, offer, chat, quality lead, and by extension, sale.
• All fees and/or charges paid by you to us for any fees are non-refundable. There will be no refunds in the event that: (i) your Account is suspended or terminated due to a breach of these Terms; and/or (ii) any Content has been removed in accordance with these Terms.

5. User Interaction

SGWatchHub.sg provides a venue for users to interact with each other and to buy and sell items. We do not pre-screen users or the Content provided by users, nor is SGWatchHub.sg directly involved in transactions between users. Consequently, SGWatchHub.sg has no control over, and you agree that we are not responsible or liable for, any of the following:

• The quality, safety, morality, legality, or authenticity of any aspect of the items advertised and/or listed, and for items listed by a user, the authenticity of such items.
• The truth or accuracy of the listings, the ability of sellers to sell items, or the ability of buyers to pay for items.
• The true identity, age, nationality, or sense of humor of a user.
• Any Content posted by users.

You are encouraged to use the features and functions available on the Services to communicate with other users and/or to find out more about an item which a user has put up for sale. However, please exercise common sense and good judgment in your interactions with other users. While SGWatchHub.sg endeavors to keep the Services safe for everyone, your use of the Services and your interactions with other users are entirely at your own risk.

6. Content

SGWatchHub.sg Services and functions allow users to create listings and/or share, post, and/or communicate content, such as photos, videos, comments, data, text, links, product descriptions, product specifications, and/or other information (“Content”). You retain ownership rights in the Content which you upload or share on the Services but you grant SGWatchHub.sg a worldwide, fully-paid, royalty-free, sub-licensable, and transferable license to host, store, use, display, reproduce, modify, adapt, edit, publish, and distribute such Content for the purpose of operating, developing, providing, promoting, and improving the Services and to research and develop new products and services.

You understand and agree that you are solely responsible for the Content which you post or share on or through the Services and any loss or damage which you sustain as a result of such Content is solely your responsibility. You acknowledge that SGWatchHub.sg does not pre-screen Content uploaded by users. SGWatchHub.sg shall have the right (but not the obligation) in its sole discretion to refuse, delete, or move any Content that is available on the Services. In using the Services or functions to create a listing, offer an item for sale, post, and/or offer a service, you agree to comply with the following:

• You must provide a fair, accurate, and complete description of each item, including your price for the item.
• Each item and/or offer of services must have its own listing.
• Your listing for an item may only include text, descriptions, graphics, images, and other content relevant to the item. All Content contained in a listing must be true, complete, accurate, and not misleading in any manner whatsoever.
• All items and/or offers of services must be listed in the appropriate category. All listings must comply with all applicable laws, regulations, guidelines or policies, and any notices, guidelines, and/or policies issued.
• Any links included in your listing must lead to your personal or corporate website and must not include any links to third-party websites.

You acknowledge and agree that sgwatchhub.sg has no control over any website other than the sgwatchhub.sg website and shall not, in any event, be responsible or held liable for any listings or expired listings which appear on any website other than the sgwatchhub.sg website or any listings or expired listings which are retrieved by any search engine.

You warrant, in respect of each and every listing, service, and/or item, product which you offer on sgwatchhub.sg that:

• You are the owner of the item, and the item is not stolen.
• The item is not counterfeit and does not infringe upon any third party’s copyright, patent, trademark, trade secret, or other proprietary or intellectual property rights.
• The sale of the item complies with all laws and regulations which apply to that item.
• The item is not dangerous, hazardous, or subject to a recall by a government or manufacturer.
• The Content in any listing does not infringe or violate any applicable laws and regulations, the intellectual property rights, or proprietary rights of a third party.

All offers made and accepted through the Services are binding.

If you are a seller who has accepted a buyer’s offer for an item:

• You agree to ship the item or otherwise complete the transaction with the buyer in a prompt manner unless there is an exceptional circumstance, for instance, if the buyer fails to meet the terms of your listing (such as payment method), or you cannot authenticate the buyer’s identity.
• You may charge reasonable shipping and handling fees to cover the costs for packaging and mailing the item. However, you must not charge excessive shipping fees or otherwise avoid fees.
• You may not alter the item’s price after a sale or misrepresent the item’s location and price.

If you are a buyer whose offer for an item has been accepted by a seller, you agree to make prompt payment to the seller for the item, unless there is an exceptional circumstance, for instance, if you cannot authenticate the seller’s identity.

In communicating with a user through the Services for the offering or acceptance of and/or services or purchase or sale of an item (each, a “Transaction”), you may obtain personal information of that user, such as their email address, phone number, and mailing address. Without obtaining prior permission from the user, you shall use such information solely for the purpose of the Transaction.

Notwithstanding the foregoing, where sgwatchhub.sg is not involved in a Transaction which is solely between users, sgwatchhub.sg cannot ensure that a user (whether as a buyer or seller) will follow through and complete a Transaction.

8. Prohibited Items, Services or Businesses

You acknowledge and agree that you shall not use the sgwatchhub.sg Platform or any affiliated platform, Payment Services, and/or the Shipping Services in connection with unlawful or illegal activities such as counterfeiting, money laundering, and counter-terrorism financing. To keep sgwatchhub.sg a safe and trusted marketplace for our community, certain items, services or businesses are not allowed to be listed for sale on our platform. This includes but is not limited to:

If you see any prohibited items, services, or businesses on sgwatchhub.sg, please report the listing so our team can take appropriate action. Together we can keep sgwatchhub.sg safe, legal, and family-friendly.

You understand and agree that all Prohibited Transactions shall be deemed void, and that sgwatchhub.sg and/or its related corporations have the right to take all steps at its sole discretion that sgwatchhub.sg deems reasonable and/or necessary to ensure that you do not use the sgwatchhub.sg Platform, Payment Services, and/or Shipping Services in connection with the Prohibited Transactions, including but not limited to the following:

• (a) remove and/or compel you to remove illegal, infringing, unlawful, or otherwise any prohibited content without advanced notice to you;
• (b) access, preserve, and/or disclose your account information and content in connection with the Prohibited Transaction to any legal, regulatory, or governmental authority, the relevant rights owner, or other third parties if required to do so by law, pursuant to an order of a court or lawful request by any governmental or regulatory authority having jurisdiction over sgwatchhub.sg;
• (c) freeze and hold the monies in your Balance if you are suspected of engaging in or found to have engaged in a Prohibited Transaction, until sgwatchhub.sg deems the matter to be resolved;
• (d) withdraw a sum from your Balance up to an amount equivalent to a Buyer’s Purchase Monies so as to reimburse a buyer in connection with a Prohibited Transaction without advance notice to you;
• (e) compel you to refund the Buyer’s Purchase Monies made in connection with a Prohibited Transaction in full to the buyer and/or sgwatchhub.sg (or its related corporations).

9. Access and Interference

Sgwatchhub.sg may contain robot exclusion headers which contain internal rules for software usage. Information on Sgwatchhub.sg may be updated on a real-time basis and is proprietary or is licensed to Sgwatchhub.sg by Sgwatchhub.sg users or third parties. You agree that you will not use any robot, spider, scraper, or other automated means to access Sgwatchhub.sg for any purpose whatsoever without Sgwatchhub.sg prior permission. Additionally, you agree that you will not:

• Take any action that imposes, or may impose, in Sgwatchhub.sg’s sole discretion, an unreasonable or disproportionately large load on Sgwatchhub.sg infrastructure.
• Copy, reproduce, modify, create derivative works from, distribute, or publicly display any user Content (except for your Content) or other allowed uses of Sgwatchub.sg from the Site except with the prior permission of Sgwatchhub.sg and the appropriate third party, as applicable.
• Interfere or attempt to interfere with the proper working of the Site or any activities conducted on the Site.
• Bypass Sgwatchhub.sg’s robot exclusion headers or other measures Sgwatchhub.sg may use to prevent or restrict access to Sgwatchhub.sg.

10. Breach

Without limiting any other remedies, Sgwatchhub.sg may, without notice delay or immediately remove Content, warn Sgwatchhub.sg community of a user’s actions, issue a warning to a user, temporarily suspend a user, temporarily or indefinitely suspend a user’s account privileges, terminate a user’s account, prohibit access to the Site, and take technical and legal steps to keep a user off the Site and refuse to provide services to a user if any of the following apply:

• Sgwatchhub.sg suspects (by information, investigation, conviction, settlement, insurance or escrow investigation, or otherwise) a user has breached this Agreement, the Privacy Policy, or other policy documents and community guidelines incorporated herein.
• Sgwatchhub.sg is unable to verify or authenticate any of your personal information or Content.
• Sgwatchhub.sg believes that a user is acting inconsistently with the letter or spirit of Sgwatchhub.sg policies, has engaged in improper or fraudulent activity in connection with Sgwatchhub.sg, or the actions may cause legal liability or financial loss to Sgwatchhub.sg users or to Sgwatchhub.sg

11. No Warranty

You acknowledge and agree that the Services are provided on an “as is” and “as available” basis, and that your use of or reliance upon the Services and any content, products, or services accessed or obtained thereby is at your sole risk and discretion. Sgwatchhub.sg does not represent or warrant that:

• The use of the Services will be secure, timely, uninterrupted, or error-free or that they will be compatible or operate in combination with any other hardware, software, system, or data.
• The Services will meet your requirements or expectations.
• Errors or defects in the Services will be corrected.
• The Services and Sgwatchhub.sg’s servers are free of viruses or other harmful components.

All conditions, representations, and warranties, whether express, implied, statutory, or otherwise, including, without limitation, any implied warranties of merchantability, fitness for a particular purpose, and non-infringement, are hereby excluded and disclaimed to the fullest extent permitted under the law. The Services may be subject to limitations, delays, and other problems inherent in the use of the Internet and electronic communications (including problems inherent in the computer or electronic device you use). Sgwatchhub.sg is not responsible for any delays, delivery failures, damages, or losses resulting from such problems. No advice or information, whether oral or written, obtained by you from Sgwatchhub.sg or from the Services shall create any representation, warranty, or guarantee. Furthermore, you acknowledge that Sgwatchhub.sg has no obligation to support or maintain the Services. Sgwatchhub.sg disclaims any and all liability or responsibility in relation to the content made available through the Services, including but not limited to the Content uploaded by users or the third-party content and services. Sgwatchhub.sg is not responsible or liable in any manner for the third-party content and services associated with or utilized in connection with the Services, including the failure of such third-party content and services. In addition, the Services may promote, advertise, or sponsor functions, events, offers, competitions, or other activities which may be conducted online or offline and which may be conducted by third parties. These activities may be subjected to separate terms and conditions; your participation in such activities is solely at your discretion and risk. Sgwatchhub.sg does not accept any responsibility in connection with your participation in activities conducted by any other party.

12. Liability Limit

In no event shall Sgwatchhub.sg, and (as applicable) Sgwatchhub.sg subsidiaries, officers, directors, employees, or Sgwatchhub.sg suppliers be liable for any damages whatsoever, whether direct, indirect, general, special, compensatory, consequential, and/or incidental, arising out of or relating to the conduct of you or anyone else in connection with the use of the Site, Sgwatchhub.sg services, or this Agreement, including without limitation, lost profits, bodily injury, emotional distress, or any special, incidental, or consequential damages. Sgwatchhub.sg liability, and (as applicable) the liability of Sgwatchhub.sg’s subsidiaries, officers, directors, creators, employees, and suppliers, to you or any third parties in any circumstance is limited to $1.

13. Indemnity

You agree to indemnify and hold Sgwatchhub.sg and (as applicable) Sgwatchhub.sg parent, subsidiaries, affiliates, officers, directors, agents, creators, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of this Agreement or the documents it incorporates by reference, or your violation of any law or the rights of a third party.

14. No Guarantee

Sgwatchhub.sg does not guarantee continuous, uninterrupted access to the Site, and the operation of the Site may be interfered with by numerous factors outside Sgwatchhub.sg control.

15. Compatibility

Sgwatchhub.sg does not warrant that the Services will be compatible or interoperable with your device or any other piece of hardware, software, equipment, or device installed on or used in connection with your device. Furthermore, you acknowledge that compatibility and interoperability problems can cause the performance of your device to diminish or fail completely, and may result in permanent damage to your device, loss of data located on your device, and corruption of the software and files located on your device. You acknowledge and agree that Sgwatchhub.sg and its subsidiaries, affiliates, partners, suppliers, and licensors shall have no liability to you for any losses suffered resulting from or arising in connection with compatibility or interoperability problems.

16. Legal Compliance; Taxes

You shall comply with all applicable domestic and international laws, statutes, ordinances, and regulations regarding your use of the Site and any Sgwatchhub.sg service and, if applicable, your listing, purchase, solicitation of offers to purchase, and sale of items. In addition, you shall be responsible for paying any and all taxes applicable to any purchases or sales of items you make on the Site (excluding any taxes on Sgwatchhub.sg’s net income).

17. Severability

If any provision of this Agreement is held unenforceable, then such provision will be modified to reflect the parties’ intention. All remaining provisions of this Agreement shall remain in full force and effect.

18. No Agency

You and Sgwatchhub.sg are independent contractors, and no agency, partnership, joint venture, employee-employer, or franchiser-franchisee relationship is intended or created by this Agreement.

19. Sgwatchhub.sg Service

Sgwatchhub.sg reserves the right to modify or terminate the Sgwatchhub.sg service for any reason, without notice, at any time. Sgwatchhub.sg reserves the right to alter these Terms of Use or other Site policies at any time.

20. Choice of Law

This Agreement shall in all respects be interpreted and construed with and by the laws of Singapore.

21. Intellectual Property

You acknowledge and agree that the Services and all copyright, patents, trademarks, trade secrets, and other intellectual property rights associated therewith are, and shall remain, the property of Sgwatchhub.sg. Furthermore, you acknowledge and agree that the source and object code of the Services and the format, directories, queries, algorithms, structure, and organization of the Services are the intellectual property and proprietary and confidential information of Sgwatchhub.sg. You are not granted any intellectual property rights in and to the Services not expressly granted in these Terms, and such rights are hereby reserved and retained by Sgwatchhub.sg.

The Services may utilize or include third-party software that is subject to open-source and third-party license terms (“Third-Party Software”). You acknowledge and agree that your right to use such Third-Party Software as part of the Services is subject to and governed by the terms and conditions of the open-source and third-party licenses applicable to such Third-Party Software, including, without limitation, any applicable acknowledgments, license terms, and disclaimers contained therein. In the event of a conflict between these Terms and the terms of such open-source or third-party licenses, the terms of the open-source or third-party licenses shall prevail regarding your use of the relevant third-party software. In no event shall the Services or components thereof be deemed to be open-source or publicly available software. You are not authorized by Sgwatchhub.sg to use Sgwatchhub.sg’s trademarks in any advertising, publicity, or in any other commercial manner without the prior written consent of Sgwatchhub.sg, which may be withheld for any or no reason.

22. Suspension and Termination

Sgwatchhub.sg reserves the right to, at its sole discretion, and without liability:

1. Suspend or terminate your Sgwatchhub.sg account (“Account”) and/or your access to the Services at any time, for any reason, and without advance notice.
2. Change, modify, suspend or discontinue, whether temporarily or permanently, the whole or any part of the Services at any time, for any reason, and without advance notice.
3. Suspend or terminate your Account and/or your access to the Services at any time due to a breach of these Terms.

23. Limitation of Liability

23.1. Your Sole Remedy

You acknowledge and agree that your only right with respect to any problems or dissatisfaction with the Services is to request for termination of your Account and/or discontinue any use of the Services.

23.2. Indirect Damages Disclaimer

In no event shall Sgwatchhub.sg or its subsidiaries, affiliates, partners, suppliers, or licensors be liable for any indirect, incidental, consequential, special, or exemplary damages arising out of or in connection with your access or use of or inability to access or use the Services or any third-party content and services, or arising out of or in connection with your conduct or the conduct of other Sgwatchhub.sg users in connection with the use of the Services including without limitation death, bodily injury, emotional distress, and/or other damages resulting from communications or meetings with other users or persons you meet through the Services, whether or not the damages were foreseeable and whether or not Sgwatchhub.sg was advised of the possibility of such damages.

24. Sub-contracting by Sgwatchhub.sg

Sgwatchhub.sg reserves the right to delegate, sub-contract, or otherwise arrange for any related corporations, service providers, partners, subcontractors, and/or agents to perform any part of the Services as Sgwatchhub.sg deems appropriate.

25. Counterfeit Policy

The sale of fake products, replicas, or counterfeits, and the creation of any content that violates any intellectual property rights is illegal and prohibited on sgwatchhub.sg’s mobile application and website (collectively, the “Platform”).

It is the responsibility of each seller to list and sell only authentic products. If you suspect a product’s authenticity, please report it.

Together we can:

1. Establish a safe Platform where users are protected from purchasing counterfeits or unauthorized goods.
2. Protect rights holders from copyright or trademark infringements.

What is considered to be a fake, replica, or counterfeit good?

Replicas or counterfeit goods are fake items intentionally made to look genuine or intended to be taken as authentic. These can include items such as clothes, bags, watches, perfume, cosmetics, unauthorized copies of software, and any other electronic items, and can also include any listing with a false or misleading description of the item.

Can I avoid infringement by clearly stating on my listing that the product is a replica or imitation/not authentic?

No. Simply disclosing that your product is not genuine does not absolve you from intellectual property infringement or offenses relating to counterfeiting.

Why should I avoid buying counterfeit goods?

There are many potential risks involved with buying fake goods:

• You could be breaking the law.
• Your safety could be at risk. Fake goods can often be of poor quality and unsafe. For example, counterfeit electrical goods are not subjected to the same rigorous safety checks as legitimate ones and are often very dangerous.
• You could be funding organized crime. Proceeds from selling counterfeit goods could be used to fund other types of serious organized crime.
• You could be affecting genuine businesses. Buying counterfeit goods affects legitimate businesses as counterfeit sales divert profits away from genuine manufacturers.

26. Requests outside of Original Agreement

Buyers are not allowed to make demands that are not part of the original agreement. Sellers are not required to agree to any additional terms from what was agreed upon at the point of purchase. If a buyer is making additional demands from what was part of the original listing and agreed upon, you will not be required to fulfill those demands.

27. Disputes with Users or Dispute with Transactions

If you are in dispute with a user of our Services or with any transactions, you are encouraged to contact that user directly to resolve the situation amicably. Sgwatchhub.sg is under no obligation to resolve them. You agree to release Sgwatchhub.sg or any of its affiliated company, social media accounts, the owner/creator of Sgwatchhub.sg and to indemnify and hold Sgwatchhub.sg or any of its affiliated company, social media accounts, the owner/creator of Sgwatchhub.sg harmless from and against any claims, demands, liabilities and/or damage arising out of or in connection with your disputes with users of our Services or any transactions being done.

28. Privacy Policy

Your privacy is very important to us at sgwatchhub.sg and we have provided the sgwatchhub.sg Privacy Policy as such (Please review the Privacy Policy to understand how Sgwatchub.sg collects, uses and discloses information collected and received from you): By interacting with us, submitting information to us or signing up for any promotions or services offered by us, you agree and consent to Sgwatchhub.sg, its related corporations and affiliates, and their respective successors-in-title as well as our respective representatives (collectively referred to herein as “Sgwatchhub.sg”, “us”, “we” or “our” and each, a “Sgwatchhub.sg Company”) collecting, using, disclosing and sharing amongst themselves your Personal Data, and disclosing such Personal Data to Sgwatchhub.sg authorised service providers and relevant third parties.

29. Third-party Sites and Resources

Our Services may, from time to time, contain links to external sites or resources which are operated by third parties. We have no control over the content and privacy practices of such sites or resources. You are advised to review the privacy policies of these sites and resources operated by third parties and understand how your information may be used by those third parties.

We may, however, share or sell the following anonymous information collected and received from you, with our third-party data management platforms or advertising and analytics partners:

• Hashed device identifiers
• Demographic information
• Location-related information
• Aggregate statistics

Our third-party data management platforms or advertising and analytics partners may collect and share your hashed device identifiers, precise location data, and other information about your device and use of the sgwatchhub.sg for advertising, research, and location analytics purposes.

We may also collect and receive information from other data management platforms or advertising and analytics partners. Such third parties may use their own cookies and/or other tracking technologies which may collect information about you on non- Sgwatchub.sg related platforms. We have no control over the content and privacy practices of such sites or resources. You are advised to review the privacy policies of these sites and resources operated by third parties and understand how your information may be used by those third parties.

We may share your information with our affiliates and with third-party service providers who assist us in performing certain aspects of our Services on our behalf, such as processing transactions, fulfilling requests for information, receiving and sending communications, updating marketing lists, analyzing data, providing support services or in other tasks.

30. Information We Collect and Receive

We may collect and receive information from you in the following situations:

• When you register for an account with us (“Account”).
• When you choose to connect your Account with an external third-party service or application, such as Facebook.
• When you use the features and functions available on our Services, for example, by creating listings, interacting with other users through our chat feature, or transacting with other users.
• If you contact us, for example, with a query or to report a problem.
• When you register for a survey, campaign, contest, and/or lucky draw with us.
• When you interact with us offline or through an external third party.

By providing us with any information relating to a third party (e.g. information of your spouse, children, parents, and/or employees), you represent to us that you have validly obtained the consent of the third party to provide us with their information for the respective purposes.

We may collect and receive the following information:

• Account credentials such as username.
• Profile information such as name, gender, email address, profile photo, mobile number, and date of birth.
• Information required for the use of the “Buy” button (including payment and shipping services and buyer protection services) such as credit or debit card details, bank account, NRIC/FIN number, address, and mobile number.
• Location information such as last known location, and meet-up location.
• Data collected through digital identity platforms (such as SingPass) or third party identity verification platforms.
• Aggregate data collected through the use of our Services.
• Any communications between you and another user of our Services.
• Unique identifiers such as device identifier, browser type and settings, device type and settings.
• Any other information disclosed by you in any of the above-mentioned methods and/or through the use of our Services.

If you come in possession of another user’s (the “Disclosing Party”) personal data through the use of the Services you agree that you will:

1. Comply with all applicable personal data protection laws with respect to any such data, including any collection, processing, storage or transfer of such data.
2. Allow sgwatchhub.sg or the Disclosing Party whose personal data you have collected (the “Receiving Party”) to remove his or her data so collected from your database.
3. Allow sgwatchhub.sg or the Disclosing Party to review what information has been collected about them by the Receiving Party, in compliance with and where required by applicable laws.

31. Your Interactions with Others

Our Services offer features that allow users to connect and communicate in groups that are public or semi-public, and to share information with each other to complete a transaction. Please use common sense and exercise good judgment when sharing information in these groups or with others. We generally do not monitor or remove the information that you share and such information may remain available on our Services after your Account has been deactivated, terminated, or is otherwise closed. You are responsible for the information you choose to share in these groups or with other users.

32. Why We Collect the Information and How We Use It

We may use the information collected and received from you for the following purposes and any other purposes:

• To verify your identity, update our records, and generally maintain your Account with us.
• Provide our Services and customize the content shown to you.
• Develop, operate, improve, deliver and maintain our Services.

• To detect or monitor any frauds or other prohibited content, businesses or activities.
• Responding to your queries and resolving complaints.

These updates will be sent by email and/or through push notifications and you can choose to unsubscribe from these marketing communications via the link in the email you have received and/or through the “Settings” page of your Account. These marketing communications may also be communicated to you through text messages and/or voice calls if you have indicated that you wish to receive such updates through these methods.

With your consent or indication of no objection, to send you marketing and/or promotional materials on the following types of products and services of sgwatchhub.sg and/or carefully selected third parties: household products, general merchandise, retail goods or services, food, water & beverages, restaurants, catering, groceries, health & beauty, lifestyle, pharmaceuticals, fragrance & cosmetics, baby products, wine and liquor, cigarettes and cigars, stationery, books and paper products, confectionary, toys, clothing, shoes, textiles, fashion accessories, bags & luggage, jewellery, watches, furniture, plants and accessories, office supplies, phones and mobile devices, electronics and electrical appliances, computer software and games, music, pet products, fuel, motor vehicle services, educational products and services, entertainments, utilities, online auction, financial, investment, insurance, banking and credit cards, logistics, transportation, shipping travel, hotel and accommodation, sports, leisure, recreation and entertainment, telecommunications products and services, financial services, insurance services and products, e-commerce (including trading and payment platforms and online auctions), reward, referral, loyalty or privilege programs and related products and services, promotional offers, discounts and/or related products and services.

To provide you with a more tailored online advertising experience. sgwatchhub.sg has in place, tools and services that are used to create advertisements, to deliver advertisements to devices on behalf of advertisers, to monitor the success of and manage advertising campaigns, and to present you with advertisements that are more likely to be interesting and relevant to you. Delivering relevant ads that are tailored to users’ interests is known as “interest-based advertising” (sometimes also referred to as “behavioral advertising”).

If you are a member of our survey panel, your information may also be used to manage your panel membership; and send you service-related messages, new survey opportunities and, updates on your rewards and incentives. These updates will be sent by email and/or through push notifications and you can choose to unsubscribe from these updates through the relevant email and/or “Settings” page of your Account. These updates may also be communicated to you through text messages and/or voice calls if you have indicated that you wish to receive such updates through these methods.

To provide and carry out cross-application and cross-device advertising (i.e. advertising across browsers and applications on a single device, as well as cross-device advertising), advertising delivery and reporting. Information includes information described above and data collected from a particular computer, browser or device and may be used with another computer, browser or device that is linked to the computer, browser or device on which such data was collected.

To generate a “Lookalike audience” or “similar audience” of prospective users through the Facebook or Google advertising platforms and/or similar service providers. This allows us to deliver targeted advertisements on their networks to potential users, where such potential users may have shared interests or similar demographics to our existing users, based on the data of these advertising platforms.

To comply with applicable Anti-Money Laundering and Countering the Financing of Terrorism regulations and other applicable laws and regulations.

33. Who We Share Your Information With

We may share your information with and/or transfer your information to our third-party service providers, agents, and/or our affiliates or related corporations, and/or other third parties, which may be located inside or outside of your jurisdiction, for one or more of the above-stated purposes.

We endeavor to ensure that the third parties and our affiliates keep your information secure from unauthorized access, collection, use, disclosure, processing, or similar risks and retain your information only for as long as your information is needed for the above-mentioned purposes.

Such third parties include, without limitation:

• Our subsidiaries, affiliates, and related corporations;
• Buyers or sellers you have transacted with or interacted with on our Platforms or in connection with your use of the Services for the above-stated purposes;
• Other users of our Platforms in relation to the information that you (i) make available on your profile and (ii) upload and/or share on or through our Services;
• The relevant seller/buyer (as the case may be), when you choose to use our (i) WhatsApp chat feature; (ii) buyer protection services and/or (iii) payment and shipping services;
• Contractors, agents, service providers, and other third parties who assist us in performing certain aspects of our Services on our behalf, such as processing transactions, payment or shipping services, fulfilling requests for information, receiving and sending communications, updating marketing lists, analyzing data, providing support services, or in other tasks. Such service providers will only have access to your personal information to the extent necessary to perform their functions. Where we share the information with third-party payment and/or deferred payment service providers for the purposes of providing you and performing certain aspects of our Service, the personal data you provide may be used to conduct matching procedures against databases of known fraudulent transactions (maintained by such third parties) verify your identity, conduct due diligence checks, reviewing/assessing and verifying your creditworthiness and standing, any risk management procedures put in place by the third party service providers, or other screening activities (including background checks) in accordance with legal or regulatory obligations;

34. Transfer of Information

By using our Services, you authorize us to use your information in Singapore and other countries where Sgwatchub.sg operates for the purposes mentioned above.

We cannot guarantee the security of your information, so it is important that you protect against unauthorized access to your Account and information by choosing your password carefully, and keeping your password and Account secure (e.g. by signing out after using our Services).

When you provide personal information about yourself to us, register with us, or update and input your information within our Services through the “Settings” page on sgwatchhub.sg, or agree for us to obtain and use your information through other means such as WhatsApp messages, phone text messages, phone calls, verbal and text agreements, or face-to-face meet-up agreements, or simply by using and browsing our website and affiliated social media, you authorize us to use your information in Singapore and other countries.

In certain circumstances, you may need to provide us with personal information about someone other than yourself. If so, we rely on you to inform these individuals that you are providing their personal information to sgwatchhub.sg, to make sure they consent to you giving us their information and to advise them or show them our Privacy Policy as well as our terms and conditions.

If you come into possession of another user’s (the “Disclosing Party”) personal data through the use of the Services, you hereby agree that you will:

• Collect, use, process, and/or disclose the personal data for the purposes in which it was provided for, in compliance with all applicable personal data protection laws with respect to any such data, and in a manner that does not cause sgwatchhub.sg to be in breach of its obligations under personal data protection laws;
• Not transfer the personal data to a place outside the country of collection without the Disclosing Party’s prior written consent. If the Disclosing Party provides consent, the personal data transferred outside of Singapore must be protected at a standard that is comparable to that under the Personal Data Protection Act 2012. If you transfer personal data to any third party overseas, you shall procure that such third party undertakes to adhere to the same;
• Protect the personal data in your control or possession by making reasonable security arrangements (including, where appropriate, physical, administrative, procedural and information & communications technology measures) to prevent unauthorized or accidental access, collection, use, disclosure, copying, modification, disposal, or destruction of personal data, or other similar risks;
• Put in place adequate measures to ensure that the personal data in your possession or control remains or is otherwise accurate and complete. In any case, you shall take steps to correct any errors in the personal data, as soon as practicable upon the Disclosing Party’s written request;
• Allow the Disclosing Party to review what information have been collected by you; and
• Upon the request of the Disclosing Party: (a) return to the Disclosing Party, all personal data; or (b) delete all personal data in your possession, and, after returning or deleting all personal data, provide the Disclosing Party with written confirmation that it no longer possesses any personal data. Where applicable, you shall also instruct all third parties to whom it has disclosed personal data for the agreed purposes to return to the Disclosing Party or delete, such personal data, in each case, in compliance with and where required by applicable laws.

35. Tracking Technologies

We may use tracking technologies in our Services. These enable us to understand how you use our Services which, in turn, helps us to provide and improve our Services.

We may deliver personalized and/or targeted advertisements (each, a “Targeted Ad”) to you in the course of your use of our Services and/or through a variety of advertising networks and exchanges.

Do note as well when you view or interact with an advertisement via any of your devices, an advertiser or advertising network or exchanges can infer that you are within their target audience; or when you click on an advertisement, the publisher and/or advertiser will know you visited the page that you clicked on and may still be able to associate personal data collected by such third parties directly from you through their cookies and similar tracking technologies.

36. Changes to this Privacy Policy

We reserve the right to make changes to this Privacy Policy at any time. Your continued use of our Services constitutes your acceptance of all current terms and conditions and privacy policy. Additionally, it implies acceptance of any changes, whether or not they are updated or directly communicated to you.
